A 51-year-old man who police said a history of elder abuse against an Oakley woman died early Friday after being shot by the woman who claimed the abuse, authorities said.

The 74-year-old woman living at the home and suspected of shooting the man was not arrested. Police posted a statement on social media, saying that they consider the fatality a case of self-defense.

Authorities identified the man as Ruben Ortiz Jr., of Stockton. Police did not say whether he was related to the woman who shot him.

“There is a history of physical violence between them,” police said in the statement. “Another act of physical violence occurred, which led the (woman) to shoot the (man) in self-defense. Due to this being a self-defense shooting, and absent any other crimes committed by the (woman), she was not booked.”

Police said there is no threat to the public.

Officers responded about 12:40 a.m. to the 200 block of W. Cypress Road after receiving reports of the shooting. They found Ortiz Jr. on the driveway of a home with at least one gunshot wound, police said.

Fire paramedics and officers tended to the man, but he died at the scene.

Police said they detained a man and two women, including the 74-year-old, after the shooting. Their investigation soon led them to find an elder abuse restraining order filed against Ortiz Jr. by the woman.
